Police Report Against Criminal Defamatory E-mail

This morning I have made a police report against Dato’ Seri Tiong King Sing for criminal defamatory statements made against me.

 

I categorically deny that I have received a RM10 million loan as alleged by Dato’ Seri Tiong.

This is the work of people who are out to undermine my integrity and obligations as Minister of Transport and President of MCA.

 

It is clear that the motive and intentions of these individuals are to derail the efforts of the Ministry of Transport and Port Klang Authority with regards the issue of Port Klang Free Zone.

 

I treat this as another hurdle of the many that I have faced in my efforts to protect the interest of the people.

 

I have also instructed my lawyers to write a letter of demand to the makers of the defamatory statements to withdraw the allegation and apologise within 7 days failing which I will institute legal proceedings against the party concerned.

 

My lawyers have been instructed to file an injunction to prevent the perpetrators of this grievous misdeed from making further defamatory allegations.

 

As President of MCA, I am confident that the party is strong enough to withstand such challenges and efforts to undermine it.

'Mana boleh tahan' with fly-for-free minister

Two private jets were 'loaned' to Transport Minister Ong Tee Keat in February and March, but much to its owner's chagrin, he had failed to pay for the expenses incurred during the four flights.


Ong had used the Learjet 60 and Gulfstream G450 belonging to Wijaya Baru Aviations Sdn Bhd two times each to fly from the Subang Jaya airport to Kuantan and Johor respectively. (see chart).

The aviation company is owned by Wijaya Baru Global Holdings Sdn Bhd, and today its deputy chief executive officer Faizal Abdullah let his frustrations fly at a press conference in Petaling Jaya.

"If you want to use (the planes) you can use, but you pay," he stressed. "It's like borrowing your neighbour's car. You have to fill petrol, pay for toll and change the motor oil."

According to Faizal, fuel costs alone would amount to between US$3,000 and US$4,000 per flight hour.


Yesterday, Malaysiakini reported that Ong 'owed' US$40,000 for using the planes, but his secretary Simon Lim claimed that the ministry was never billed for it.

Responding to Lim, Faizal said one of the minister's assistants had approached Wijaya Baru's staff to request for the use of the jets and there was no official business deal involved.

"How to give bill? We're not doing business... if he doesn't want to pay, up to him. All the charges, fuel, pilot and crew have been paid by us.

"Why do we have to bill him if he knows he used it?" he added.

Four times - 'mana boleh tahan'

Faizal also revealed that after the cost was not reimbursed four times in a row, the company declined to let Ong use the plane for a fifth time on April 24.

"So after the first four times he ignored or buat tak tau, we couldn't tell him to pay first. So we just said (on his fifth request) that the plane was not available.


"Maybe he knows the plane was there and became angry, because a few weeks later the PwC report came out," he said.

The PwC report refers to the PriceWaterhouse Coopers audit of Port Klang Free Zone, in which Wijaya Baru, through its subsidiary Kuala Dimensi Sdn Bhd, is the turnkey developer.

Kuala Dimensi has since filed a defamation suit against PwC and the Port Klang Authority over the contents of the report.

Asked if the jets were loaned to the MCA president due to the good rapport between the company and the minister, Faizal denied this.

"He is a minister. I don't see him as Ong Tee Keat. I see him as a minister. He must have some accountability and responsibility...

"Dia guna empat kali ini macam, mana boleh tahan (This happened four times, how can we stand it)?" he said.

Nevertheless, Faizal said the company will not pursue Ong for the arrears. "He is a minister. We can't ask him to pay. That is very rude. Mati lah!"

He added that there were several other ministers and MCA politicians who 'borrowed' the planes but they have paid for the cost of using them.

Currently, the company does not perform commercial flights but will do so in the future once permission has been obtained.

Report: Ministers cannot use private jets

In a related development, China Press reported that the government's General Order stated that all officials including ministers can only fly Malaysia Airlines, AirAsia and use government owned cars.

Quoting an anonymous government source, the report added that at no time are ministers allowed to use private aircraft.

The source said all external expenses must be given prior approval by the chief secretary of the ministry because the ministry treasury will issue a 'local order'.

"Thus, the transport minister and his secretary's statement that they have not received an invoice is misleading the public.

"Under the local order, post-dated invoices or bills cannot be claimed," said the source.

However, the source said that under emergency situations, the transport ministers could use Civil Aviation Department aircrafts.

Kit Siang is not your enemy. He is your beloved political friend. He took his time & the trouble to make police report on the whole PKFZ fiasco.

The following article is extracted from Malaysiakini for your readers. Yes, the Public not only judge you by your actions but the public also judge you by how you handle the denials after denials. It does not need to be a smart and/or intelligent person to sum up that Tiong King Sing will not simply make a wild allegations against someone who is the President of the 2nd largest party in BN !!

DAP veteran Lim Kit Siang lodged a police report over statements made by Kuala Dimensi Sdn Bhd (KDSB) chief executive Tiong King Sing and deputy chief executive Faizal Abdullah over the PKFZ fiasco.


Lim also wants police to investigate MCA president Ong Tee Keat for denying Tiong's claim that he received RM10 million from Tiong.

The Ipoh Timor MP lodged a report at 1.30 pm today at the SS2 police station in Petaling Jaya and asked police to look into:

Tiong King Sing's statement that he donated RM10 million to Ong Tee Keat last year.
Faizal Abdullah's statement that Ong had used KDSB's company jet five times, and owed the company US$40,000.
Ong's denial that he received a RM10 million "loan" from Tiong, and that his office had yet to receive invoices for the US$40,000.

'Someone is lying'

Lim urged the police and the MACC to investigate the statements to see if criminal offenses have been committed by Ong and Tiong.

"I think these allegations show that either Ong Tee Keat or Tiong (King Sing) is telling a lie. Either Tiong or Ong must face the consequences or step down," he said.

Speaking to reporters later, Lim labeled the matter as "grave and of public interest" concerning the integrity of Ong and Tiong.

"This has cast a new shadow over the whole question of the integrity of the Najib government," he said.

Lim also brought up the death threats that Ong allegedly received last month.

He called for the police to look into whether or not the death threats received by the transport minister was connected to the PKFZ scandal.

Seen with Lim today at the police station were Tony Pua (Petaling Jaya Utara MP), Lim Lip Eng (Segambut MP), Tan Kok Wai (Cheras MP), Jeff Ooi (Jelutong MP) and Fong Kui Lun (Bukit Bintang MP).

Lim decided to lodge a police report following Tiong's saying that he had 'donated' RM10 million to Ong last year.

Minister in the Prime Minister's Department Mohd Nazri Abdul Aziz suggested that the allegations hurled by BN Backbenchers Club chairman Tiong King Sing against Transport Minister Ong Kee Teat be investigated by the Malaysian Anti-Corruption Commission (MACC).

He said the matter should be handed over to MACC to open a case on the explosive allegations.

According to Nazri, it was the responsibility of the commission to determine if there had been any act of corruption.

"We have to remember that not only the person who receives; the person who gives bribes also stands to be accused," he said.

Nazri said this during his visit to the MACC office here.

'Donation' made on Ong's request

Nazri, who is in charge of the parliamentary affairs and anti-corruption, was asked to comment on the allegations made by Tiong, the MP for Bintulu and Sarawak Progressive Democratic Party treasurer-general, that he had donated RM10 million to Ong to be channeled to MCA last year.

He said as of now, he could not see the tiff between Tiong and Ong, who is also the MCA president, as having anything to do with their positions in BN.

Tiong's allegations published in Malaysiakini yesterday stated that the donation was made on Ong's request because Tiong supported MCA's activities.

In the wake of the allegations, Ong today lodged a police report.

Apa yang tak betul, katakan tak betul. Janganlah kalau tak betul pun, boleh dikatakan betul.Hitam jadi putih, putih jadi hitam. Rakyat bukan bodoh untuk menilai percakapan yang digunakan anda. YB Tee Keat hanya menjalankan tanggungjawab untuk membetulkan kembali apa yang tak betul dalam PKFZ. Adakah ini pun dikatakan salah? Kerajaan tidak seharusnya melindungi individu yang didapati melakukan kesalahan dalam PKFZ kerana ia melibatkan wang rakyat.

Kepada YB Tee Keat, teruskanlah dengan usaha murni anda untuk memperbetulkan kembali PKFZ.

This is influence buying. He used the political influence to plunder the citizens.

dear Dato, why not just pay off the flight charges and close the case ?
i dont think because of 10million this should be investigated la, the MACC should only concentrate on pakatan people and not BN.

Whatever it is , do not get disheartened and continue to be steadfast in what you set to do for the country and rakyat. Though I am not a member of MCA, I have high regard for you. Continue the work without fear or favour.
